General Terms and Conditions (GTC) of Cannaphilie

(Cannaphilie is an independent brand within Harmonie Foods GbR.)

1. Scope of Application

These General Terms and Conditions apply to all orders placed through the online shop at www.cannaphilie.de. The operator and contractual partner is Harmonie Foods GbR, Heglau 25, 91732 Merkendorf (hereinafter "Seller"), which operates under the independent brand Cannaphilie.

2. Contracting Party and Conclusion of Contract

The purchase contract is concluded exclusively between the customer and Harmonie Foods GbR. Cannaphilie is the brand under which the products are offered. The customer makes purchases in their own name and for their own account. Delivery is made directly from the supplier to the customer via dropshipping.

3. Products and Intended Use

All products offered are exclusively propagation material (cannabis seeds and cannabis cuttings) in accordance with § 1 No. 6 and No. 7 KCanG. They may be used exclusively for permitted private self-cultivation of a maximum of 3 female cannabis plants per adult in private property (§ 9 KCanG). Commercial resale, transfer, or use for other purposes is expressly prohibited.

4. Prices, Payment and Delivery

Prices are final prices including statutory VAT. Shipping costs are displayed separately in the shopping cart.

Payment methods: PayPal, credit card, instant bank transfer (Sofortüberweisung), Klarna (invoice / installment purchase) or prepayment (depending on current shop configuration).

Delivery conditions: Delivery is made directly from the supplier to the customer via dropshipping. Delivery time is usually 3–7 business days after receipt of payment (depending on availability in the partner CMS). The supplier is entitled to reject orders within 3 working days.

5. Right of Withdrawal and Return

There is no right of withdrawal or return for living plants, cuttings, or seeds, as these are perishable goods or goods delivered in sealed packaging (§ 312g para. 2 No. 1 BGB in conjunction with point 3.3 of the dropshipping agreement with GoG GmbH). A right of exchange or cancellation is expressly excluded.

6. Warranty and Liability

The warranty is governed by statutory provisions. The seller is liable only for the delivery of propagation material as described (point 8.1 of the dropshipping agreement). Liability for indirect damages, loss of profit, or improper use is excluded. Defects must be reported immediately upon receipt.

7. Age Restriction and Quantity Limit

Orders are only possible for persons aged 18 and over. The maximum quantity per order and month is 7 seeds or 5 cuttings (or a combination of up to a maximum of 5 items). By placing an order, the customer confirms their age of majority and compliance with the quantity limits.

8. Data Protection

The seller processes personal data exclusively within the framework of the GDPR and the DSG. Details are regulated in the separate Privacy Policy on www.cannaphilie.de. The customer agrees to the processing of data necessary for contract execution.

9. Final Provisions

• Should a provision be invalid, the remaining provisions shall remain valid.
• German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.
• The place of jurisdiction is – as far as legally permissible – the seller's registered office or the customer's place of residence.
